Having a character sing a song

If I want to have a character sing a song in my script, such as singing along with the radio or dancing around their house singing and I have a specific song I want to use for that, is that a copyright issue? I have a scene where I have my main character singing along with the radio at work after hours and I want her to be singing a specific song. Any guidance or suggestions would be greatly appreciated!!!

Yes but it is the producer who is responsible to secure the right to the music if the right are available. Unless it has something to do with the plot I wouldn't bother but there is no rule that says you can't.

I've paid for "Sync Rights." It's a simple process: find out whether it's BMI or ASCAP, they have a owner's name and contact. Put out a feeler for the cost.

Here's a trick: ask for Festival pricing (if that's where you're headed). It'll be cheaper, and while doing that negotiate a price for open distribution at the same time.

I secured "Hot Fun in the Summertime." Sly Stone charged $3000, but the film could not be shown in Texas festivals. ???

Brian Wilson gave me "All Summer Long" for free - in festivals.

As Dan said, is it critical. Look into alternative songs, perhaps, if your dream song is too pricey or not available.

This is for a spec script, not something you are producing yourself, correct? If so, just put the song in. At this point, you are only evoking a certain tone or style or meaning for the character and story for a reader. If/when the script goes into development and is produced those legal details will be worked out... a different song may be used if the song in the spec is too pricey or not available, or maybe some cover version could be used, or maybe it is left out entirely. ;)
