No matter who you are or where you’re from, the journey to becoming a full-time and successful actor in America is a difficult one. If you’re an independent filmmaker or producer working to put together a film or TV project, you are likely going to have multiple producers, investors, financiers, sales agents, and talent that are will be looking to recoup profits on the completed project. This can get tricky. Not only do you have to keep your numbers and figures straight to properly reallocate your revenues, you also likely have to handle guild residuals, navigate liability issues and ensure every party is happy and trusting in the process. This can ultimately be a very messy process, and one that you should not handle on your own as the film’s producer. Instead, it’s probably time you have a collection account. A collection account is an account in the name of a neutral third party who receives revenues generated by an independent film or TV project on behalf of the multiple beneficiaries from local distributors. This process is called collection account management and is an effective tool to guarantee that the beneficiaries receive their share of the revenues. Collection account management is a massive time saver and a way to lower the chances of errors or improper payments. But it’s also the industry standard and something most parties and investors are going to expect you to have if they are considering moving forward. So how exactly does collection account management work and how can you best use this process to your advantage as an independent filmmaker? It’s undeniable that we’re witnessing a new era of unscripted television. The staggering, cultural success of shows like TIGER KING, CHEER, I’LL BE GONE IN THE DARK, and LAST CHANCE U signify in no uncertain terms that the appetite is huge for premium docuseries and will likely continue to be for at least the near future. The water is warm for premium docuseries, but that doesn’t mean someone can just put together their own unscripted series willy nilly. Finding a subject and crafting a format that will resonate with audiences and find success with a network is no small feat and requires a lot of hard work and an understanding of what makes this type of content successful. In today’s rapidly evolving television landscape, one of the greatest challenges that producers face is how to develop series that will actually resonate in such an increasingly crowded space. Gone are the days of having an idea, putting a 3-page deck together and pitching it to 30 different networks in the hopes that several of them will make offers to further develop the series. Instead, the most effective way to produce a docu-series in today’s world is to secure many more parts of the package when bringing a new project to market. In a world of talent, access, format and projected story arc, the development of different types of shows require us to ask different questions of ourselves early on and throughout the development process. A hot topic of conversation in our current COVID-19 world is how film, television and new media productions will resume production safely and effectively. The entire entertainment legal landscape has changed as a result of the world’s pandemic. Producers, filmmakers, directors and crew need to think about protection before you can ever step on set to say “action.” It’s important to take a deeper look at the legal agreements that tie parties together on a project as we contemplate the future. Contract provisions that parties wrote off as “boring” or “boiler plate” will significantly change moving forward. It’s important you understand how this affects your project. You don’t want to get stuck with a production or financial nightmare if you’re not protected legally to move forward on your film, TV or new media project. There are five basic provisions in a legal contract that many dismissed as “boring boiler plate” that now will have significance moving forward. It’s important that you know the basic purpose of these provisions, why they are drafted and what purpose they serve for all parties. With each provision, you will need to know the impact and implications as it relates to COVID-19 and how these provisions will continue to change to comply with government and guilds, insurance coverage and mitigation of risk for both parties. You need to make sure to contemplate unlikely scenarios so that contracts are comprehensive to whatever may occur. However, these platforms have different needs, different expectations and different boundaries and mandates than those of traditional broadcast networks. So how does a creative navigate this brave new world? And how does a writer stand out to get staffed or sell a standout drama series?
