Using patented existing technology in Sci-Fi script

Hello everyone

I was wondering about the legal issues related to using patented existing technology in the sci-fi script. Is there any regulations or limitations?

In short are we allowed to use such technologies in our script or do we have to get consent from inventor or patent holder?

A patent only protects the inventor's claims in the patent.

I would like to specifiy my question. I would like to use Hyperloop concept in my script. We know Hyperloop is Tesla and SpaceX's concept and they are developing it. I have read that Hyperloop cincept was derived from Magnetic Tube Train concept which was first written in 20th century in sci-fi novel.

Do you think l can use exact Hyperloop term in my script?

For example, they went to travel to New York via Hyperloop.

Is this allowed?

What if Hyperloop gets broken due to outside environment force in the script. Is it okay?

If it's a real-world product, you can use it. But don't defame it. If you do that, and finance your own film, you may get sued, and your film may be prevented from going to market. as scheduled (that's happened before). If you defame it, and someone else buys your script, they may take it out of your script or ask you to change it (if they are legal-savvy and aware of such things).

In a more best-case situation, any product that is "placed" in a show or film usually pays for that service in one way or another - either in actual cash; in return services; or in co-branding ways. Positively portraying an actual product in your script may work to your benefit in that case. And, of course, big studios better have the ability to do that than small companies, and even have departments whose task is to maximize those ROI's. But even small indie films have been shot and have received something in return for product placements.

Like I said a patent claims protect the claims. I doubt there would be a trademark issue but the producer is the one responsible for what appears on film so they are the ones who are responsible for obtaining clearances for their movie not the screenwriter.

I totally agree with this statement A.S Templeton . Can you suggest, any writing courses? Workshops? Is it good to go with official education like University degree in MA Arts or workshops, training courses?
