Im a disabled Army Veteran who can't seem to get the help from either west or east L.a. VA s. Here's the short of it,..I moved here just last July, 2013 and after my 1 yr was up I went to month to month,..and in this month of Sept. the manager offered me full rent and deposit if I moved out by the 15th. I refused, I wasn't ready to move,...Now, by the 17th, I have a big emergency with both parents in and out of the hospital in Murfreesboro, TN. and they called me asking me to come back to help them. I am willing to move back there. I told the managers and they told me I cant have my deposit til they rent out my room!!! I know this is illegal. So how can I get them to give me my deposit so I can move? my room is ready and cleaned for a new tenant. Anyone....?
IDK if you still need an answer, but if you don't give 30 days notice, the landlord is entitled to your rent for the 30 days. And he has 30 days after vacating to send you a letter itemizing any deductions for your deposit and return the balance. Regardless if he has found a new tenant or not.
thanks, but i read the cali renters law for security deposit and they have only 21 days to hold the deposit,...but they keep tellin me that they need to rent it out b4 they give me my money....that is illegal. they didnt do anything to the room,...and its now up for rent...plus they said i had to replace the A/C even though its not in my contract.
Well as long as you gave your appropriate notice, then at the end of the 21 days, take them to court.
They're telling you they have to wait to find a new tenant to return your security b/c they spent it. Which is illegal. Security is to be held in a separate interest bearing account. You can file a compliant with teh housing authority.
the 23rd they just told me that the statement was mailed to me. I had to move to TN for my parents and their health. So I asked them if the deposit is with it.?.. they havent got back to me yet. Even though im 2,032 miles away I might just have to sue them, cuz I know they took out money for that A/C. But I have to wait for the statement.
