TV Broadcasters won't accept upscaled video as HD. if its a documentary and has archived footage then you have a case to argue but even then the archive footage cannot compromise more than 20% of the programme.
Through trial and error I have yet to find software that converts SD to HD well. Some do an okay job faking it, but there just isn't enough information in SD footage to up-convert to HD. And in my exp...

And in my experience, Elisar is correct - a TV broadcaster looking for HD will not accept SD video masquerading as HD. That said you should look at hardware like the RH10UC
